1. Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and FitWardrobe ("we", "us", or "our").

By accessing or using the FitWardrobe application (available as an Android APK, Progressive Web App, or future iOS app), you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you do not agree to these Terms, you must immediately cease using FitWardrobe.

2. Eligibility

2.1 Age Requirement

FitWardrobe is intended for users who are at least 13 years of age. By using the service, you represent and warrant that:

• You are at least 13 years old
• If you are between 13-18 years old, you have obtained parental or guardian consent
• You have the legal capacity to enter into this agreement

2.2 Geographic Restrictions

FitWardrobe is primarily designed for users in India but is accessible globally. You are responsible for ensuring that your use complies with local laws in your jurisdiction.

2.3 Prohibited Jurisdictions

We reserve the right to restrict access from certain jurisdictions for legal or operational reasons.

3. User Accounts

3.1 Account Creation

To use FitWardrobe, you must create an account by providing:

• A valid email address
• A secure password (managed via Supabase authentication)

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access

We are not liable for losses resulting from unauthorized use of your account.

3.3 Account Accuracy

You must provide accurate, current, and complete information during registration. False or misleading information may result in account suspension or termination.

3.4 Account Transfer

You may not transfer, sell, or share your FitWardrobe account with any third party.

4. Acceptable Use Policy

4.1 Permitted Uses

You may use FitWardrobe for:

• Personal, non-commercial wardrobe organization
• Generating AI-powered outfit suggestions for personal use
• Storing and managing your clothing inventory

4.2 Prohibited Uses

You agree NOT to:

• ❌ Use the service for any illegal, harmful, or fraudulent purpose
• ❌ Upload inappropriate, offensive, or copyrighted images not owned by you
• ❌ Attempt to reverse engineer, decompile, or hack the application
• ❌ Use automated bots or scripts to access the service
• ❌ Abuse AI features (e.g., excessive API requests, spam)
• ❌ Impersonate others or create fake accounts
• ❌ Interfere with the service's operation or other users' access
• ❌ Scrape, data mine, or extract data from the service
• ❌ Use the service for commercial purposes without written permission
• ❌ Transmit viruses, malware, or malicious code

5. Intellectual Property Rights

5.1 FitWardrobe Ownership

All intellectual property rights in FitWardrobe, including but not limited to:

• Software code, algorithms, and architecture
• User interface design and graphics
• FitWardrobe logo, trademarks, and branding
• Documentation and marketing materials

...are owned exclusively by FitWardrobe and are protected by Indian and international copyright, trademark, and intellectual property laws.

5.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to use FitWardrobe for personal, non-commercial purposes in accordance with these Terms.

This license does NOT permit you to:

• Modify, distribute, or create derivative works
• Resell or sublicense the service
• Remove copyright or proprietary notices

5.3 Third-Party Trademarks

Google Gemini, Supabase, Capacitor, and other third-party names mentioned are trademarks of their respective owners. Use of these names does not imply endorsement.

6. User-Generated Content

6.1 Ownership of Your Content

You retain all ownership rights to the content you create and upload to FitWardrobe, including:

• Clothing images
• Wardrobe item descriptions
• Custom tags and categories
• Outfit combinations

6.2 License to Use AI Features

When you use AI-powered features, you grant FitWardrobe a temporary, limited license to:

• Send your images to Google Gemini API for analysis
• Process the AI-generated results and return them to you

This license terminates immediately after processing is complete. Images are NOT stored by FitWardrobe or Google.

6.3 Content Responsibility

You are solely responsible for the content you upload. You warrant that:

• You own or have the right to upload all images
• Your content does not violate any third-party rights
• Your content does not contain illegal, harmful, or offensive material

We reserve the right to refuse service if we become aware of inappropriate content, though we do not monitor local device storage.

7. AI Features and Disclaimers

7.1 AI-Powered Features & Technology Stack

FitWardrobe integrates two advanced AI systems to deliver intelligent fashion assistance:

Image Analysis: Google Gemini 2.0 Flash

• Functionality: Analyzes clothing photographs using computer vision
• Capabilities: Identifies garment types, colors, patterns, styles, and attributes
• Accuracy: AI vision may misidentify items, colors, or styles
• Limitations: May not recognize all clothing types, especially ethnic wear variations

Conversational AI & Styling: Groq

• Functionality: Powers natural language chat interface for outfit planning
• Capabilities: Generates outfit combinations, provides style advice, answers wardrobe questions
• Accuracy: AI suggestions are generated based on patterns and may not match personal taste
• Limitations: Cannot understand complex personal preferences, cultural context, or real-world appropriateness

Combined AI Workflow

When you use FitWardrobe's AI features, the workflow is as follows:

1. You upload a clothing photo → Gemini analyzes and tags the item
2. You ask "What should I wear today?" → Groq generates outfit suggestions using Gemini-tagged items
3. All results are stored locally on your device (not in the cloud)

Third-Party AI Processing: By using AI features, you acknowledge that:

• Images are sent to Google Gemini API for temporary processing
• Chat messages are sent to Groq API for temporary processing
• These providers operate under their own terms and privacy policies
• FitWardrobe does not control these third-party AI systems

7.2 No Professional Advice

FitWardrobe does not provide professional fashion advice, styling services, or personal shopping consultation. All outputs are for entertainment and informational purposes only.

7.3 AI System Changes

We reserve the right to change, upgrade, or replace AI providers (Google Gemini, Groq, or others) at any time without notice, provided similar functionality is maintained.

8. Service Availability

8.1 Beta Status

FitWardrobe is currently in beta testing phase. This means:

• The service may contain bugs, errors, or incomplete features
• Performance may not be optimal
• Features may be added, changed, or removed without notice
• Downtime or service interruptions may occur

8.2 No Uptime Guarantee

We do not guarantee that FitWardrobe will be available 24/7 or free from errors. We reserve the right to:

• Perform maintenance or upgrades
• Suspend service temporarily for technical reasons
• Discontinue features or the entire service with notice

8.3 Third-Party Dependencies

FitWardrobe relies on third-party services (Supabase, Google Gemini API, Vercel). Outages or issues with these services may affect FitWardrobe's availability.

9. Fees and Payment

9.1 Free Service

FitWardrobe is currently 100% free during the beta testing phase. There are:

• ❌ No subscription fees
• ❌ No in-app purchases
• ❌ No advertisements
• ❌ No hidden charges

9.2 Lifetime Free Access for Beta Testers

Users who join during the beta testing phase will receive lifetime free access to FitWardrobe's core features, even if we introduce paid tiers in the future.

9.3 Future Monetization

We reserve the right to introduce paid features, premium tiers, or other monetization models in the future. Beta testers will be notified in advance and will retain free access to core features.

10. Termination

10.1 Termination by User

You may terminate your account at any time by:

• Using the "Delete Account" feature in the app settings
• Emailing us at [email protected]

Upon termination:

• Your email address will be deleted from our servers within 30 days
• Local wardrobe data on your device will remain until you uninstall the app or clear browser data

10.2 Termination by FitWardrobe

We reserve the right to suspend or terminate your account immediately, without notice, if:

• You violate these Terms or the Acceptable Use Policy
• You engage in fraudulent, illegal, or harmful activity
• We are required to do so by law or legal request
• We decide to discontinue the service

10.3 Effect of Termination

Upon termination:

• Your right to use FitWardrobe immediately ceases
• All licenses granted to you are revoked
• We are not liable for any losses resulting from termination

11. Disclaimers and Limitations of Liability

11.1 "AS IS" Service

11.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are NOT liable for any indirect, incidental, consequential, or punitive damages
• We are NOT liable for data loss, device damage, or security breaches
• We are NOT liable for fashion mishaps, wardrobe decisions, or styling outcomes based on AI suggestions
• Our total liability is limited to the amount you paid us (which is $0 for free beta users)

11.3 Force Majeure

We are not liable for failures caused by events beyond our reasonable control, including natural disasters, internet outages, third-party service failures, or government actions.

11.4 Jurisdictional Variations

Some jurisdictions do not allow limitations on implied warranties or liability for incidental/consequential damages. If you are in such a jurisdiction, these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless FitWardrobe, its developers, affiliates, and service providers from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use or misuse of FitWardrobe
• Your violation of these Terms
• Your violation of any third-party rights (including intellectual property or privacy rights)
• Content you upload or create within the app

13. Governing Law and Dispute Resolution

13.1 Governing Law

These Terms are governed by the laws of India, including:

• The Information Technology Act, 2000
• The Digital Personal Data Protection Act, 2023
• The Indian Contract Act, 1872

13.2 Jurisdiction

Any disputes arising from these Terms or your use of FitWardrobe shall be subject to the exclusive jurisdiction of the courts in Meerut, Uttar Pradesh, India.

13.3 Dispute Resolution Process

1. Informal Resolution: Contact us at [email protected] to resolve disputes amicably
2. Mediation: If informal resolution fails, parties agree to attempt mediation before litigation
3. Legal Action: As a last resort, disputes may be resolved through Indian courts

14. Modifications to Terms

14.1 Right to Modify

We reserve the right to modify these Terms at any time. Changes may be made to:

• Reflect new features or services
• Comply with legal requirements
• Improve clarity or enforce policies

14.2 Notification of Changes

Material changes will be communicated via:

• Email notification to registered users
• In-app notice upon next login
• Updated "Last Updated" date at the top of this page

14.3 Acceptance of Changes

Your continued use of FitWardrobe after changes constitutes acceptance of the modified Terms. If you do not agree, you may delete your account.
